Terms and Conditions

I, {name}, understand and agree to the following terms and conditions of membership at Shape Jiu Jitsu:

Membership and Billing

Shape Jiu Jitsu operates a year-round program, and payments are made on a recurring fortnightly schedule until a cancellation is submitted in accordance with the cancellation policy.

Billing Consistency

Recurring billing schedules are not modified due to class or venue changes, public holidays, or other unforeseen circumstances. Classes missed due to these reasons are not eligible for refunds or make-up sessions.

Fee Adjustments

Changes to membership fees will be communicated via email with at least 30 days’ notice. By signing this agreement, you authorise Shape Jiu Jitsu to adjust your recurring billing schedule in accordance with any price changes.

Class Access

Membership fees entitle members to attend all classes included in their membership package, with the understanding that some classes may have experience or skill-level requirements. Class schedules and offerings are subject to change at the discretion of Shape Jiu Jitsu.

Code of Conduct

Members are expected to maintain respectful behavior towards instructors, staff, and fellow members at all times. Disruptive or inappropriate behavior, including but not limited to verbal or physical misconduct, may result in suspension or termination of membership. The final decision regarding such matters rests with Shape Jiu Jitsu management.

Cancellation Policy

a. Cancellations must be submitted in writing to hello@shapejiujitsu.com.

b. Cancellations must be sent to the administration office, not to instructors.

c. Please allow up to 14 days for processing recurring billing cancellations. If a payment is processed during this time, no refund will be issued.

d. Shape Jiu Jitsu does not charge cancellation fees.

Refund Policy

Refunds are not provided for unused classes or partial membership periods, except in cases where Shape Jiu Jitsu terminates the membership agreement. Any remaining prepaid fees will be refunded in such cases.

Membership Pauses

Members may request a pause in recurring billing for pre-planned absences of 4 weeks (28 days) or longer. Notification must be submitted at least 14 days prior to the planned absence. Approval is subject to Shape Jiu Jitsu’s discretion.

Changes to Classes

Shape Jiu Jitsu reserves the right to modify class schedules, venues, or instructors at its discretion. Efforts will be made to provide suitable alternatives where possible, and members will be notified of significant changes.

Amendments to Terms and Conditions

Shape Jiu Jitsu reserves the right to amend these terms and conditions at any time. Members will be notified of changes via one or more of the following: social media, a notice posted at the training venue, or an email to the most recent address provided.

Acceptance of Terms

The most up-to-date version of the terms and conditions will always apply and supersede any previous versions or verbal agreements.

Facility and Services Amendments

Shape Jiu Jitsu and its staff reserve the right to amend rules, services, or fitness offerings at any time without prior notice.

Membership Termination by Shape Jiu Jitsu

Shape Jiu Jitsu staff reserve the right to terminate memberships at any time, with written notice and without compensation. However, any prepaid fees for the remaining membership period will be refunded.

Consent to Media Use

Members consent to and authorise Shape Jiu Jitsu to use photographs, videos, recorded audio, written or recorded testimonials, first name and initial, suburb, and age for promotional purposes related to the academy’s activities. This consent can be revoked in writing; however, materials already in use at the time of revocation will not be removed.

Email and Phone Communication

Members authorise Shape Jiu Jitsu to add their email and phone number to communication lists for updates, news, and notifications. Members can opt out of communications via provided links or replies to texts/emails.

Discrepancies in Information

In the event of discrepancies between these terms and any verbal communication from Shape Jiu Jitsu staff, the terms outlined in the most up-to-date version of this document will take precedence.

Activity Waiver Form

In consideration of being allowed to participate in the Activity and other good and valuable consideration, the receipt of which is hereby acknowledged, I {name} of {address} (the "Participant") agree with Shape Jiu Jitsu of Building 2, G.03, 1 Dairy Road, Fyshwick ACT 2609 (the "Activity Provider") to the following:

Details of Activity

The Participant will be participating in the following activity: Brazilian Jiu Jitsu (the "Activity") provided by Shape Jiu Jitsu (the "Activity Provider").

Consideration

Being of lawful age and in consideration of being permitted to participate in the Activity, the Participant releases and forever discharges the Activity Provider, its owners, directors, officers, employees, agents, assigns, legal representatives, and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the Activity, and notwithstanding that such damage, loss, or injury may have been caused solely or partly by the negligence of the Activity Provider.

The Participant understands that the Participant would not be permitted to participate in the Activity unless the Participant signed this Waiver.

Concurrent Release

The Participant acknowledges that this Waiver is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant by the Activity Provider, and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives, and assigns.

Fitness to Participate

• The Participant understands that it is their responsibility to consult a physician regarding their ability to participate in the physical activities and/or use Shape Jiu Jitsu equipment and facilities.

• The Participant shall not use Shape Jiu Jitsu facilities and/or equipment or participate in any activities while suffering from any infections or contagious illness, disease, or other ailment (including but not limited to open cuts, abrasions, open sores, or minor infections) that may pose a risk to other participants.

• Shape Jiu Jitsu equipment and facilities may pose a risk of injury, particularly if the Participant has not received instruction in their use. The Participant must seek advice from Shape Jiu Jitsu staff regarding correct equipment use.

• Any person who is pregnant, under medication, or suffering from any medical condition is strongly advised to seek the advice of a qualified medical practitioner before using Shape Jiu Jitsu equipment or participating in any physical activities.

• No person under the influence of drugs or alcohol is permitted to use Shape Jiu Jitsu equipment, facilities, or participate in physical activities.

Limitation of Liability

• The Participant acknowledges that participating in physical activities at Shape Jiu Jitsu and using its equipment and facilities carries inherent risks.

• To the fullest extent permitted by applicable law, Shape Jiu Jitsu, its related entities, employees, and agents shall not be liable for any loss or damage to property, bodily injuries, illness, or death sustained by the Participant, their guests, or third parties within the facilities.

• The Participant understands and voluntarily accepts the risks associated with participation. Shape Jiu Jitsu shall not be liable for any claims, demands, damages, economic losses, reputational damage, or any special or consequential losses related to the Participant’s use of Shape Jiu Jitsu’s facilities and services.

• The Participant agrees to fully indemnify Shape Jiu Jitsu against any claims, liabilities, expenses, damages, or losses arising from any breach of these terms or any act, omission, or negligence by the Participant or their guest.

Full and Final Settlement

The Participant acknowledges and agrees that:

1. Shape Jiu Jitsu has given them sufficient time to carefully read this Waiver.

2. The Participant has had the opportunity to seek independent legal advice before signing.

3. The Participant fully understands the risks and claims being waived.

4. The Participant is freely and voluntarily executing this Waiver.

5. The Participant is permanently waiving their right to sue or make claims against Shape Jiu Jitsu for any injury or loss sustained during participation in the Activity.

Governing Law

This Waiver is governed by and construed in accordance with the laws of the Australian Capital Territory.
